What are the changes

The pivotal change involves granting direct authority to the FIFA Disciplinary Committee to enforce private settlement agreements intricately linked to conclusive and binding financial decisions issued by FIFA or the Court of Arbitration for Sport (CAS). These provisions, embedded within Article 21 of the FIFA Disciplinary Code, are applicable to agreements finalised on or after February 1, 2023.

The expanded scope of enforcement is not solely confined to settlements reached after the initiation of disciplinary proceedings. It also encompasses agreements formulated subsequent to any financial decision pronounced by FIFA or CAS. This extension intends to streamline the resolution process, eradicating the necessity for supplementary proceedings before the Football Tribunal.

Scope limitations

FIFA has specified the limits within which these changes apply. Settlements negotiated outside the prescribed scenarios outlined in Circular No. 1867 will continue to adhere to previous guidelines set in FIFA Circular No. 1628. Such settlements will result in the automatic closure of ongoing disciplinary proceedings, and any breaches thereof must be appropriately addressed. Claims arising from breaches can be lodged with the Players’ Status Chamber or the Dispute Resolution Chamber, or can be submitted to mutually agreed-upon competent bodies at the national or international level.
